Mandatory Compliance Poster Changes

All employers are required to post mandatory compliance posters in an area visible to all employees within each workplace. In 2014 there were 50 mandatory changes to the combined federal and state posters and in 2015 there have been 43.

Are your organization’s combined federal or single state posters up-to-date?

Arizona

  • The Industrial Commission of Arizona has released an updated Minimum Wage posting that lists the 2015 minimum wage rate of $8.05 per hour. Employers should display the updated poster as of January 1, 2015, the day the new rate takes effect

Colorado

  • The Colorado Department of Labor and Employment has updated its Minimum Wage Order 31 posting to indicate the new rate of $8.23 per hour, effective January 1, 2015. It also lists the new tipped employee wage of $5.21 per hour. In addition, the revised posting includes updated information about recovery of wages in a civil action or a minimum wage complaint. Since the revised posting also lists the 2014 minimum wage rate, employers can display the updated poster as soon as it is received.

Hawaii

  • Hawaii has updated its Wage and Hour Laws posting to include the new minimum wage of $7.75 per hour effective 1/1/15, as well as future increases. Revisions regarding tipped employee wages, direct deposit and work injuries are also included. In addition, minor changes to Unemployment Insurance, Discrimination, Dislocated Workers, OSHA and Workers Compensation postings have also been made.

Illinois

  • The Illinois Department of Human Rights is releasing a Pregnancy Accommodation posting that summarizes protections for women under the Illinois Human Rights Act. Amendments to this law take effect January 1, 2015.

Indiana

  • The Indiana Department of Labor has made a mandatory change to its Teen Work Hour Restrictions posting. It now states that 16-year-olds may work until 11 p.m. on nights followed by a school day if they have parental permission. The posting is required for employers of minors who are 14, 15, 16 or 17 years old.

Kentucky

  • No mandatory changes.

Massachusetts

  • A new Earned Sick Time notice describes who qualifies for sick leave, when it must be paid, how it is earned, and when it can be used. The earned sick time law takes effect July 1.
  • A revised Fair Employment posting now includes information about parental leave and protections for domestic workers. These laws took effect in April, but the Fair Employment posting was not updated until May.   Massachusetts has now made four mandatory changes this year.

New York

  • The New York State Department of Labor has published a revised Minimum Wage posting. The updated posting reflects the new state minimum wage rate of $8.75 per hour effective December 31, 2014.

Ohio

  • The Ohio Department of Commerce has published an updated Minimum Wage posting that lists the 2015 minimum wage rate of $8.10 per hour and the 2015 tipped employee rate of $4.05 per hour. The rate applies to employers who gross more $297,000 annually. Employers who gross less than that amount must pay employees at least the federal minimum wage rate. Employers should begin displaying the poster stating the new rate on January 1, 2015.

Oregon

The Oregon Bureau of Labor and Industries has published an updated Minimum Wage posting that lists the 2015 minimum wage rate of $9.25 per hour. It also adds details about meal periods for minors. Meal periods of at least 30 minutes must be provided to non-exempt minor employees who work for six or more hours at a time. Employers should begin displaying the poster stating the new rate on January 1, 2015.
